1. Parties
This Membership Agreement (“Agreement”) is concluded between DAMA ART ORGANİZASYON TURİZM TİCARET LİMİTED ŞİRKETİ (“Dama Müzik”) (registered address: Taburlar Sitesi, Pınarbaşı, Atatürk Blv. 28/BA, 07070 Konyaaltı/Antalya – Türkiye) and the natural person Member (“Member”) of www.damamuzik.com (“Website”) regarding the use of the services (“Services”).
2. Purpose & Scope
Dama Müzik operates the e-commerce platform at www.damamuzik.com and sells the products/services listed thereon. By becoming a member, the Member may purchase such products/services. This Agreement sets forth the terms of use and the parties’ rights and obligations.
3. Definitions
Cookie Policy: Statement on cookies used for operation, experience and personalization.
Privacy Policy: Statement on how personal data is collected/used/transferred.
My Account Page: Member’s personal page accessible only with username/password.
Website: www.damamuzik.com.
4. Rights & Obligations
Membership requires approval of this Agreement and provision of accurate and up-to-date information. The minimum age is 18. The membership starts upon confirmation. The Member bears all responsibility for incorrect information and may cancel membership any time.
In case of dispute over account ownership, Dama Müzik may deem the last payer via that account as the owner (without prejudice to Dama Müzik’s right to assess otherwise).
The Member assumes all legal obligations for any transaction initiated on the Website and shall comply with law, ethics and site rules. Credentials are created/kept confidential by the Member; actions with such credentials are deemed performed by the Member.
Prohibited uses include reverse engineering, false identities, unauthorized account use, misuse of ratings/reviews, distribution of harmful code, automated scraping/copying, and any act that harms the site. The Member must take reasonable technical precautions.
5. Privacy & Personal Data
Dama Müzik processes personal data in compliance with Turkish Law No. 6698 (KVKK) and applicable legislation, pursuant to the Privacy Policy and Cookie Policy. Data subject requests: iletisim@damamuzik.com. (The KVKK Privacy Notice is published separately.)
6. Intellectual Property
All IP owned by Dama Müzik or right holders may not be used, reproduced, distributed, displayed or derived without consent.
7. Amendments
Dama Müzik may amend this Agreement and policies unilaterally by publishing on the Website, provided compliance with law. Changes take effect upon publication. The Member may not unilaterally amend the Agreement.
8. Force Majeure
Events beyond control (e.g., war, strikes, cyber-attacks, outages, natural disasters, epidemics) suspending or delaying performance shall not constitute a breach; Dama Müzik is not liable.
9. Miscellaneous
Evidence: Dama Müzik’s commercial/electronic records are conclusive evidence.
Governing Law & Jurisdiction: Turkish law applies. Courts and Enforcement Offices of Antalya (Türkiye) have exclusive jurisdiction.
10. Notices
Communications may be sent to the Member’s registered e-mail or via SMS. The Member must keep contact details up to date.
11. Entire Agreement & Severability
Invalidity of any provision shall not affect the remainder.
12. Assignment
The Member may not assign rights/obligations without Dama Müzik’s prior written consent.
13. No Waiver
Failure to exercise any right shall not be deemed a waiver.
This Agreement becomes effective upon the Member’s electronic acceptance.
