1. PARTIES
BUYER: Name/Company, Address, Phone, E-mail — as stated on the order form.
SELLER: Dama Müzik, Taburlar Sitesi, Pınarbaşı, Atatürk Blv. 28/BA, 07070 Konyaaltı/Antalya – Türkiye, Tel +90 540 076 89 45, E-mail iletisim@damamuzik.com, Website www.damamuzik.com.
By confirming the order, the BUYER accepts to pay the total price and any applicable charges (shipping, taxes, etc.).
2. DEFINITIONS
Law No. 6502 on Consumer Protection (“Law”), Distance Contracts Regulation (“Regulation”), Service, Seller, Buyer, Website, Goods — as defined in Turkish legislation.
3. SUBJECT
Sale and delivery of the product/service ordered on the Website; prices valid until updated; time-limited offers valid for the announced period.
4–8. SELLER/BUYER/ORDER/INVOICE
Seller details as above. Buyer, orderer and invoice details are as stated on the order form. Prices include taxes; shipping fee belongs to the Buyer unless otherwise stated. Invoice is delivered with the order or issued electronically.
9. GENERAL TERMS
Buyer confirms preliminary information electronically; delivery within the period indicated (not exceeding 30 days) to the Buyer or designated person; Seller undertakes conformity, completeness and legal compliance; in case of impossibility, informs within 3 days and refunds within 14 days; security/chargeback and force majeure rules apply; Buyer must inspect on delivery and refuse damaged goods; links to third-party sites are for convenience only.
10. RIGHT OF WITHDRAWAL
Buyer may withdraw within 14 days from delivery for goods (from conclusion for services, except where performance has begun with consent). Written notice required; product, invoice (and return invoice for companies), packaging and accessories must be returned intact. Seller refunds within 10 days of receiving the notice and collects goods within 20 days. Deductions may apply for diminished value caused by the Buyer.
11. EXCEPTIONS
Custom-made goods; sealed items unsuitable for return due to health/hygiene once unsealed (e.g. wind instruments); goods liable to deteriorate; inseparably mixed goods; digital content supplied immediately; unsealed audio/video/software/supplies are non-returnable under the Regulation.
12. DEFAULT
In credit card default, the Buyer is liable to the bank under the card agreement and shall compensate Seller’s damages.
13. DISPUTE RESOLUTION
Turkish law applies. Applications are made to Consumer Arbitration Boards or Consumer Courts within the statutory monetary limits (updated annually). The Buyer may apply in their domicile or where the transaction took place.
14. EFFECTIVENESS
Effective upon electronic confirmation by the Buyer on the Website.
